Terms of Use

The agreement between you and Klymb when you use the website, KlymbOS dashboard, community and Klymb AI.

1. Who we are and accepting these terms

These Terms of Use (“Terms”) govern your access to and use of the Klymb website, the KlymbOS dashboard, the Klymb community, Klymb AI and related services (together, the “Services”), operated by Klymb [(Pty) Ltd], registration number [REGISTRATION NUMBER], with its registered address at [REGISTERED ADDRESS], South Africa (“Klymb”, “we”, “us”).

By creating an account or using the Services you confirm that you are at least 18 years old, have read these Terms, and agree to be bound by them together with our Privacy Policy, Cookie Policy, Payments Policy and Risk Disclaimer. If you do not agree, do not use the Services.

2. What Klymb is — and is not

Klymb provides general market information, educational content, analytics tools, AI-generated commentary and a community forum. Klymb is not a broker, exchange, custodian or bank, and does not execute trades or hold client funds.

Unless and until Klymb holds the appropriate licence and tells you so in writing, nothing in the Services is a recommendation, advice or an intermediary service as defined in the Financial Advisory and Intermediary Services Act, 37 of 2002 (“FAIS”). See our Risk Disclaimer.

3. Your account

  • Provide accurate information and keep your login details confidential.
  • You are responsible for activity on your account. Tell us promptly at legal@klymb.co.za if you suspect unauthorised use.
  • We may suspend or close accounts that breach these Terms or put other users at risk.

4. Community rules

When you post in the Klymb community you agree not to:

  • promote pump-and-dump schemes, market manipulation, or undisclosed paid promotion;
  • impersonate a licensed financial adviser or misstate your credentials;
  • share another person’s personal information, or content you have no right to share;
  • post unlawful, hateful, harassing, misleading or spam content; or
  • solicit funds, sell signals, or run “account management” services.

Disclose any position you hold in an asset you discuss. You keep ownership of your content and grant Klymb a non-exclusive, royalty-free licence to host, display and moderate it within the Services. We may remove content or restrict accounts at our discretion.

5. Klymb AI

Klymb AI produces automated responses using third-party large language models. Output may be incomplete, out of date or wrong, and is provided for general educational purposes only. Do not enter passwords, ID numbers, banking details or other sensitive personal information into Klymb AI. Always verify AI output independently before acting on it.

6. Market data

Prices, charts, signals and prediction-market probabilities may be delayed, estimated or illustrative (labelled “Demo”). We do not guarantee the accuracy, completeness or timeliness of any data and are not liable for decisions made using it.

7. Subscriptions and fees

Paid plans, billing, renewals, cancellations and refunds are governed by our Payments Policy.

8. Intellectual property

The Services, including the Klymb name, logo, software, design and content (excluding user content), belong to Klymb or its licensors. You may not copy, scrape, resell, reverse engineer or create derivative works from the Services without our written permission.

9. Liability

To the extent permitted by law, including the Consumer Protection Act, 68 of 2008, the Services are provided “as is”. Klymb is not liable for trading losses, lost profits or indirect or consequential loss arising from your use of the Services. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim.

Nothing in these Terms limits liability that cannot lawfully be limited.

10. Changes, termination and governing law

We may update these Terms and will notify you of material changes. You may stop using the Services at any time. These Terms are governed by the laws of the Republic of South Africa, and the courts of South Africa have jurisdiction. Electronic communications between us comply with the Electronic Communications and Transactions Act, 25 of 2002. Questions: legal@klymb.co.za.
